Custom Cake Terms and Conditions

Thank you for placing an order with us! We love to create beautiful cake creations for special events. To avoid disappointment, please keep in mind that your order is not confirmed unless a payment has been made. Please review the description of your order carefully to ensure all details are correct. If you discover that you have made a mistake with your order, please contact us immediately. We may be able to accommodate changes. We do not cater for dietary restrictions. 2 weeks’ notice is required of any intention to cancel. All deposits paid are non-refundable. Any refund of balance payments made is at our discretion. Administration fees may be deducted. No refunds are available on orders cancelled within 2 weeks of an event date.

Terms of Use

The supply of any products or services by Bryson Webb Pty Ltd (trading as Studio Cakes and Cake & Icing Centre) is subject to the terms, conditions, disclaimers and statements contained below and referred to collectively as the “Terms of Use”. Before engaging Studio Cakes in any service or ordering any products, please ensure you have read and understood the Terms of Use.

When you submit an order to us, give any delivery instruction, make payment of any invoice, accept delivery of products or engage us in any service, this shall in any event constitute your unqualified acceptance of these Terms of Use. Nothing in these Terms of Use affects your statutory rights (including the right to insist that goods you buy from businesses must correspond with their description, be fit for their purpose and be of satisfactory quality).

No other terms or changes to the Terms of Use shall be binding unless agreed in writing and signed by us. These Terms of Use shall prevail over any separate terms or conditions that you submit, propose or stipulate in whatever form and at whatever time, whether in writing, by email or orally.

Studio Cakes may, at its sole discretion, amend or modify the Terms of Use at any time. Amendments or modifications to the Terms of Use will be effective immediately. Any subsequent engagement of Studio Cakes by you will constitute an acceptance of those modifications.

Deposits & Cancellations

Orders are not confirmed without a non-refundable deposit. Payment of this deposit signifies your acceptance of an agreed quote, these Terms and Conditions, and approval of all artwork and designs, if any. Bookings are accepted at our discretion and will not occur without your acceptance of these items.

We must be notified at least 2 weeks prior to the event of any intention to cancel. All deposits paid are non-refundable. Any refund of balance payments made is at our sole discretion and we may deduct administration fees from balance payments. No refunds are available on orders cancelled within 2 weeks of an event date.

Refund Policy

Any consideration for refunds requires that the following conditions are met:

- you have contacted us to report your concern with the product within 24 hours of receipt of the product;

- your product is returned within 24 hours for inspection, predominantly intact (not consumed);

Refunds are provided solely at our discretion. Please take due care to store perishable items appropriately and in accordance with the storage instructions. We cannot accept responsibility for products that have been stored in inappropriate conditions.

Design

As part of our quoting process, we may provide a description and in some cases a sketch or photo reference of the agreed design. We will endeavour to fulfil your expectation of the design. However, we may take creative license with the agreed design depending on availability of stock and weather conditions. As is the nature with any creative work, there may be slight variations in the final product compared to the design. At times, we will need to make certain decisions during the process of manufacture that may affect the style of decoration, proportion or structure of the cake. The acceptance of changes to design after an order is placed is solely at our discretion and we cannot guarantee that we will be able to amend your order in accordance with your exact instructions.

Dietary Restrictions

We do not cater to customers with allergies. Some of our recipes are gluten free, however, all of our products are produced using the same kitchen facilities and utensils. We therefore advise that all of our products may contain traces of gluten. We are also unable to guarantee that our cakes do not have traces of nuts, eggs, dairy, soy etc. and do not cater to customers with allergy requests. Your acceptance of these Terms of Use indicate your understanding that our products may contain traces of gluten, eggs, soy and nuts.

Collection and Delivery

Collections can be made from our store at 651 Samford Road, Mitchelton, during our opening hours. If you fail to attend our store during opening hours, you may miss out on collection of your goods. Your order will then be available the next time our store is open. We are not responsible for reminding you of your collection date, and failure to pick up your goods at the agreed time is not grounds for a refund or cancellation.

If you have opted for our delivery services, you are required to submit information to us for the purpose of fulfilling your order such as address and venue contact details. The information provided must be accurate and kept up to date. It is your responsibility to inform us of changes to your event's details. We cannot be held responsible for any loss or damages due to inaccurate supply of information, including incorrect delivery address details. We are also not obliged to re-send the order to the correct address at our expense.

Any person who accepts the goods at the delivery address will be taken to have been authorised to receive the goods by you. We will not be held responsible for the order once delivery has occurred. If there is no one available to take delivery of the order at the agreed time, your order may be returned to our store. Redelivery will incur an additional delivery fee.

Once delivery has occurred, photographs may be taken of the order as evidence of the condition of the product at the time of delivery. Some venues do not allow us to place the goods in the display location due to unavailability of the room or table and it is not our responsibility to wait at the delivery location until rooms or tables are available. In these instances, we will leave the boxed goods with the venue and it is no longer our responsibility to safely store and then present your goods. 

We endeavour to meet our estimated time of delivery. You agree that when we are satisfied that the order has been delivered, delivery of the order has taken place within the terms of the agreement between you and us.

Without limiting the operation of any other Terms of Use, we will not accept liability for any loss or damage arising from a late delivery or for loss or damage arising after delivery has taken place and you agree that late delivery does not constitute a failure of our agreement, and does not entitle you to cancellation of an order.

Quality and Maintenance of Goods

We stand by the quality of our products and guarantee their performance and results. It is important to remember, however, that perishable items and edible products must be stored appropriately and in accordance with the storage instructions. Once delivery or collection has occurred quality and maintenance of the product is your responsibility. We cannot accept responsibility for products that have been stored in inappropriate conditions or consumed outside of a reasonable timeframe for freshly baked products. Supply of Personal Information

Throughout the process of placing an order, you will be required to provide personal information. We will not share, sell or trade your personal details with outside parties except to the extent necessary to provide the requested service or delivery or if required under law. You must only submit to us information which is accurate and not misleading and you must keep it up to date and inform us of changes. We cannot be held responsible for any loss or damages due to inaccurate supply of information, including incorrect delivery address details or incorrect contact details.

Circumstances Beyond our Control

We will not be liable for any breach, hindrance or delay in the provision of goods or services due to causes beyond our reasonable control, including without limitation any natural disaster and unavoidable incident, actions of third parties, third party software, failure or problems with public utility supplies (including electrical, telecoms or Internet failure), shortage of or inability to obtain supplies, materials, equipment or transportation, regardless of whether the circumstances in question could have been foreseen.

Copyrights and Restrictions

All material produced by our business, including, but not limited to images, illustrations, cake and cupcake designs, photographs or images of products created by us (including but not limited to cakes, cupcakes, macarons and other items), packaging, styling, formatting and layouts, brochures, quotations, descriptions and any other information is protected by copyright, and other intellectual property rights which are owned and controlled by Bryson Webb Pty Ltd. Our products and any information provided to you is solely for your personal, non-commercial use.

Such material may not be copied, reproduced, republished, modified, uploaded, posted, transmitted, or distributed in any way, including by email or other electronic means, without our express prior written consent.

No materials produced by Bryson Webb Pty Ltd may be reproduced, adapted, uploaded to a third party, linked to, framed, performed in public, distributed or transmitted in any form by any process without our express prior written consent.

Release & Indemnity

You agree to waive any and all claims that you now have or may have in the future against Bryson Webb Pty Ltd which relate to or are incidental to any transaction. You agree to indemnify and hold Bryson Webb Pty Ltd harmless from and against any and all claims, loss or expense that may be incurred by Bryson Webb Pty Ltd which relate to or are incidental to the performance of its duties as described in these

Terms of Use including all costs of defending itself against a claim by any other person and/or as a result of you taking any action or refraining from taking any action or instituting or defending any action or legal proceeding.

You further agree to indemnify and hold Bryson Webb Pty Ltd harmless from any claim made by any third party due to or arising out of your use of our services, the violation of these Terms of Use by you, or the infringement by you, or other users of our website using your membership account, of any intellectual property or other right of any person or entity.
